We at Dallmayr Pay GmbH are committed to protecting your privacy. This Privacy Policy applies to both our Websites (Dallmayr.de) and our Cloud Service (the Cloud Service), including our associated mobile applications (Mobile Apps) owned and controlled by Dallmayr Pay.
When you use the Cloud Service, we may collect and store general, non-identifiable information about pages accessed, usage of Service features, geographic location, the device you are using, an anonymized version of your IP address and the address of web sites that refer you to the Service. We also store your email address and UserID that you choose when you register for an account. We may use this information to protect us and our users from spam, viruses, identity theft, illegal or harmful activities, as well as to understand how people use the Service, which features work and which don’t, and to help us develop and improve the Service. We may create anonymous records by excluding personally identifiable information (such as your name) from records. We may collect information from you, so as to refine and enhance the services we can offer to you. We will only collect this data with your consent.
This Privacy Policy governs our data collection, processing and usage practices. It also describes your choices regarding use, access and correction of your personal information. If you do not agree with the data practices described in this Privacy Policy, you should not use the Websites or the Cloud Service.
We periodically update this Privacy Policy. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by sending you an email notification, or if you use to the Cloud Service, through the Dallmayr Pay app.

Our online Clouds Service allows users to register and use our services. These services include
inviting other users and visitors.
The information added to the Cloud Service either by users themselves or when a Cloud Service
user adds the information, is stored and managed on our service providers' servers. This
information is then used to contact visitors or facilitate bookings by the Cloud Service user.
Our customers use the Cloud Service to invite Visitors, allow access to their Property, bookings or manage Property information. Dallmayr Pay does not control the content the customer provides or the types of information that our customers may choose to collect or manage using the Cloud Service. That information belongs to them and is used, disclosed and protected by them according to their privacy policies and is not subject to this Privacy Policy. Dallmayr Pay processes our customers' information as they direct and in accordance with our agreements with our customers, and we store it on our service providers' servers, but we do not have control over its collection or management. Our agreements with our customers prohibit us from using that information, except as necessary to provide and improve the Cloud Service, as permitted by this Privacy Policy, and as required by law. We have no direct relationship with individuals who provide Personal Information to our customers. Dallmayr Pay acknowledges that you have the right to access your Personal Information. Our customers control and are responsible for correcting, deleting or updating information they have collected from you using the Cloud Service. If requested to remove data, we will respond within a reasonable timeframe. We may work with our customers to help them provide notice to their visitors about their data collection, processing and usage. Our agreements with our customers prohibit them from using the Cloud Service to collect, manage, or process Sensitive Information. We are not responsible for our customers' use of information they collect on the Cloud Service.
Dallmayr Pay collects information under the direction of its customers and has no direct relationship with the individuals whose Personal Information it processes. If you are a customer of one of our customers and would no longer like to be contacted by one of our customer that use our Cloud Service, please contact the customer that you interact with directly. We may transfer Personal Information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our customers.
This refers to credit or debit card numbers, personal financial account information, Social Security numbers, passport numbers, driver's license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial or health information.
We will do our best to resist baseless legal requests to access information. However, we may
disclose User’s information or content to satisfy a law, regulation, legal process,
governmental request or governmental order. Our policy is to give you advance notice if we are
required to release your information unless by law we are prohibited from or advised against
doing so.
If we think that by disclosing your information may prevent serious harm to us, to you, or to
anyone else for that matter, we may do so without notifying you. Finally, we may disclose your
information if we believe it is necessary to detect, prevent, or otherwise address safety,
fraud, or security concerns related to the Service.
You are free to explore the Websites without providing any Personal Information about yourself. When you visit the Websites or register for the Cloud Service, we request that you provide Personal Information about yourself, and we collect Navigational Information.
In addition to information we collect on our Websites, when you use our Mobile Apps or Web App we may also collect your city location, device model and version, device identifier (or “UDID”), OS version, and your Dallmayr Pay Cloud Service credentials.
We send push and email notifications on certain events (for example: if your visitor arrives). If you no longer wish to receive such communications, you may turn them off at the device level for push notifications and notification settings within the app.
This refers to any information that you voluntarily submit to us and that identifies you
personally, including contact information, such as your name, e-mail address, company name,
address, phone number, and other information about yourself or your business. Personal
Information can also include information about any transactions, both free and paid, that you
enter into on the Websites, and information about you that is available on the internet, such as
from Facebook,
LinkedIn, Twitter and Google, or publicly available information that we acquire from service
providers.
Personal Information also includes Navigational Information or Payment Information where such
information can directly or indirectly identify an individual. Navigational information refers
to information about your computer and your visits to this website such as your IP address,
geographical location, browser type, referral source, length of visit and pages viewed. Please
see the "Navigation Information" section below. Except for this, we do not collect Sensitive
Information
from you.
When you use our services our view content provided by us, we automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used by Dallmayr Pay for the operation of the Cloud Service, to maintain quality of the Cloud Service, and to provide general statistics regarding use of the Dallmayr Pay Website.
The Websites are not intended for or targeted at children under 16, and we do not knowingly or intentionally collect information about children under 16 If you believe that we have collected information about a child under 16, please contact us at hotline-dcs@dallmayr.de, so that we may delete the information.
We do not make money from selling advertising through the Software Service, serving ads to you, or selling information about you to third parties, including advertisers, data brokers, search engines, or anyone else. We may share your information, including personal information, with third parties under several circumstances, including (1) if you tell us it is OK to do so (2) if there is a need to do so to comply with applicable law or legal obligations (3) if we contract with a third party service provider to offer services for our users — for example, with a credit card processing company if you decide to buy something through the Service
We use the information we collect only in compliance with this Privacy Policy. Customers who subscribe to our Cloud Services are obligated through our agreements with them to comply with this Privacy Policy.
We will never sell your Personal Information to any third party.

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you.
If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.
We use Navigational Information to operate and improve the Websites and the Cloud Service. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information within our Apps.
We use a variety of security technologies and procedures to help protect your Personal
Information from unauthorized access, use or disclosure. We secure the Personal Information you
provide on computer servers in a controlled, secure environment, protected from unauthorized
access, use or disclosure. All Personal Information is protected using appropriate physical,
technical and organizational measures.
We additionally use a variety of industry-standard security technologies and procedures designed
to help protect your information from unauthorized access, use, or disclosure. Despite these
measures, you should know that we cannot fully eliminate security risks associated with
information and mistakes may happen. You can access or change your personal profile and contact
information or delete your account through our personal settings. If you choose to delete or
deactivate
the account, you can no longer retrieve the content or reactivate the account, and we cannot do
so for you. Also, your username may become available for another person to use.
We integrate the maps of the service "OpenStreetMap" (https://www.openstreetmap.de), which are offered on the basis of the Open
Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF).
As far as we know, OpenStreetMap will only use the user's data for the purpose of displaying the
map functions and temporarily storing the selected settings. This data may include in particular
the IP addresses and location data of users, which, however, may not be collected without their
consent (as a rule within the framework of the settings of their mobile devices).
We also use base maps provided by CartoDB.

Our Websites provide links to other websites. We do not control, and are not responsible for, the content or practices of these other websites. Our provision of such links does not constitute our endorsement of these other websites, their content, their owners, or their practices. This Privacy Policy does not apply to these other websites, which are subject to any privacy and other policies they may have.
How long we keep information we collect about you depends on the type of information. as described in further detail below.
After such time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible.
We retain Personal Information that you provide to us where we have an ongoing legitimate
business need to do so (for example, as long as is required in order to contact you about the
Cloud Service or our other services, or as needed to comply with our legal obligations, resolve
disputes and enforce our agreements).
When we have no ongoing legitimate business need to process your Personal Information, we
securely delete the information or anonymise it or, if this is not possible, then we will
securely store your Personal Information and isolate it from any further processing until
deletion is possible. We will delete this information from the servers at an earlier date if you
so request, as described in "To Unsubscribe from Our Communications" below.
If you provide information to our customers as part of their use of the Cloud Service, our
customers decide how long to retain the personal information they collect from you. If a
customer terminates its use of the Cloud Service, then we will provide customer with access to
all information stored for the customer by the Cloud Service, including any Personal Information
provided by you, for export by the customer according to our agreement with our customer. After
termination,
we may, unless legally prohibited, delete all customer information, including your Personal
Information, from the Cloud Service.
We employ other companies and people to provide services to visitors to our Websites, our customers, and users of the Cloud Service and may need to share your information with them to provide information, products or services to you.
We also share only the absolute necessary amount of data.
In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and customer data handling policies.
If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by Dallmayr Pay on the Websites and the Cloud Service. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your Personal Information, and choices you may have regarding your Personal Information.
We reserve the right to use or disclose your Personal Information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.
Dallmayr Pay uses so called Session-Cookies if you login to the cloud service. Otherwise no cookies are used.

Die allgemeinen Geschäftsbedingungen (nachfolgend „AGB“ genannt) gelten für sämtliche Rechtsgeschäfte, die mit der Dallmayr Pay Applikation für Smartphones abgeschlossen werden.
Dallmayr Automatenservice SAc (nachfolgend „Dallmayr“ genannt) behält sich das Recht vor, diese AGB jederzeit zu ändern. Diese AGB gelten als akzeptiert, sobald der Kunde sich über die App die AGB gelesen, verstanden und akzeptiert hat. Entgegenstehende oder von diesen AGB abweichende Bedingungen der Kundschaft werden nicht anerkannt.
Dallmayr ist an gesetzliche Geheimhaltungspflichten gebunden. Der Kunde ist einverstanden, dass der Umstand der Geschäftsbeziehung und Stammdaten (z.B. Name) zur Erbringung von Dienstleistungen soweit notwendig an den Zahlungsempfänger sowie an weitere Dritte, bekannt gegeben werden können.
Dem Kunden wird zugesichert, dass die Inhaltsdaten von Geschäftsbeziehungen (z.B. Zahlungsdaten) grundsätzlich geheim sind. Der Kunde ist jedoch einverstanden, dass die gesetzliche Geheimhaltungspflicht zur Wahrung berechtigter Interessen der Dallmayr aber insbesondere in folgenden Fällen aufgehoben ist:
Beim Umgang mit der Dallmayr Pay App sind insbesondere folgende Sorgfaltspflichten zu beachten:
Die Haftung der Dallmayr für Folgeschäden, entgangenen Gewinn, Datenverluste ist – soweit gesetzlich zulässig – in jedem Fall ausgeschlossen. Dallmayr haftet auch nicht für Schäden infolge rechts- oder vertragswidriger Nutzung der Dallmayr Pay App.
Der technische Zugang zu den Dienstleistungen ist Sache des Kunden. Dallmayr übernimmt keine Haftung für die Netzbetreiber (Provider) und lehnt soweit gesetzlich zulässig, auch jede Haftung für die zur Nutzung der Dienstleistungen erforderliche Hard- und Software ab.
Die Haftung der Dallmayr für Schäden, die dem Kunden durch Übermittlungsfehler, in Fällen höherer Gewalt, technische Mängel oder Störungen, insbesondere durch einen Ausfall von Beacons oder fehlender Internetverbindung, rechtwidrige Eingriffe in Telekommunikationseinrichtungen und –netze, Überlastung des Netzes, mutwillige Verstopfung der elektronischen Zugänge durch Dritte, Unterbrüche oder andere Unzulänglichkeiten entstehen, ist, soweit gesetzlich zulässig, ausgeschlossen.
Dallmayr ist bemüht, eine störungsfreie und ununterbrochene Nutzung der Dallmayr Pay App zur Verfügung zu stellen. Dallmayr kann dies aber nicht zu jeder Zeit gewährleisten. Dallmayr behält sich insbesondere bei der Feststellung von erhöhten Sicherheitsrisiken oder Störungen sowie für Wartungsarbeiten vor, den Zugang zur Dallmayr Pay App und/oder die darin angebotenen Dienstleistungen jederzeit zu unterbrechen. Solange Dallmayr die geschäftsübliche Sorgfalt wahrnimmt, trägt der Kunde einen allfälligen aufgrund derartiger Unterbrüche entstehenden Schaden.
Der Kunde ist ausdrücklich damit einverstanden, dass Dallmayr zur Erbringung ihrer Dienstleistungen Dritte (z.B. Payment Service Provider) beiziehen darf und dass dabei Kundendaten, soweit erforderlich, weitergegeben werden können. Dallmayr ist zu einer sorgfältigen Auswahl, Instruktion und Kontrolle der Dienstleister verpflichtet.
Der Dritte darf die Daten ausschliesslich gemäss der vorliegenden Datenschutzerklärung im Auftrag von Dallmayr verwenden. Eine Verwendung der Daten zu eigenen Zwecken des Dritten ist untersagt.
Dallmayr trägt gegenüber dem Kunden die Verantwortung für die datenschutzkonforme Bearbeitung der Daten.
Der maximale Saldo des Dallmayr Pay App Guthabens ist auf CHF 300.- begrenzt.
Das Dallmayr Pay App Guthaben wird vom Kunden über die hierfür in der App vorgesehenen Optionen aufgeladen. Zahlungsfunktion und Ladung können, je nach ausgewählter Ladeoption durch den Kunden, zeitlich zusammenfallen. Es handelt sich jedoch um zwei separate Transaktionen, wobei immer zuerst eine Ladung des Dallmayr Pay App Guthabens erforderlich ist, bevor die anschliessende Zahlung erfolgen kann. Der Kunde hat allfällige mit der Ladung verbundene Transaktions- oder sonstige Gebühren selber zu tragen.
Das Dallmayr Pay App Guthaben wird nicht verzinst.
Der Kunde kann mit dem Dallmayr Pay App Guthaben nur bezahlen, sofern dieses einen positiven Saldo aufweist.
Der Kunde kann mit seinem Smartphone und dem damit verbundenen Dallmayr Pay App Guthaben an entsprechend ausgerüsteten Automaten im Rahmen der geltenden Limiten bargeldlos bezahlen.
Bei der Bezahlung über das Dallmayr Pay App wird der entsprechende Betrag direkt vom Dallmayr Pay App Guthaben abgebucht. Der Kunde anerkennt alle auf dem Dallmayr Pay App Guthaben verbuchten Zahlungen, die in Verbindung mit seinem Smartphone getätigt wurden.
Dallmayr wird jeweils bestimmen, an welchen ausgerüsteten Automaten der Kunde mit seinem Smartphone und dem damit verbundenen Dallmayr Pay App Guthaben Zahlungen vornehmen kann.
Die Geschäftsbeziehung zwischen dem Kunden und Dallmayr wird für unbestimmte Dauer abgeschlossen. Der Kunde kann die Dallmayr Pay App jederzeit löschen. Die Löschung der Dallmayr Pay App befreit den Kunden von jeglichen Verpflichtungen der AGB und hebt die Geschäftsbeziehung mit sofortiger Wirkung auf.
Sollte eine Bestimmung der vorliegenden AGB ganz oder teilweise ungültig oder unwirksam sein, wird dadurch die Gültigkeit der übrigen Bestimmungen nicht berührt. Dallmayr und der Kunde verpflichten sich in diesem Fall die unwirksame Bestimmung durch eine ihrem Sinn und Zweck möglichst gelichwertige Bestimmung zu ersetzen.
Soweit gesetzlich zulässig, unterstehen alle Rechtsbeziehungen zwischen dem Kunden und Dallmayr ausschliesslich dem materiellen schweizerischen Recht, unter Ausschluss von Kollisionsrecht und unter Ausschluss von Staatsverträgen. Unter dem Vorbehalt von entgegenstehenden zwingenden gesetzlichen Bestimmungen ist ausschliesslicher Gerichtsstand für alle Verfahrensarten Lugano.
